Terms of service

These terms govern your use of the Modern Mining Supplies website and your purchase of products from us. By placing an order, you agree to them.

Who we are

This store is operated by Modern Mining Supplies LLC, a Texas limited liability company, 809 Lloyd Lane, Apt A, Elgin, TX 78621, United States. You can reach us at hello@modernminingsupplies.com.

Eligibility

You must be at least 18 years old and able to enter into a contract to buy from us.

Our products

We sell tools and supplies for recreational gold prospecting. Product photos and descriptions are given in good faith. Colours and finishes can vary a little from what you see on your screen.

Safety

Our products contain strong rare-earth magnets. Please read our Safety and Warnings page before use. It forms part of these terms.

Orders and pricing

All prices are in US dollars and do not include sales tax, which is added at checkout where it applies. Your order is an offer to buy. We accept it when we ship. We may refuse or cancel any order, including where an item is out of stock or where a price or description was obviously wrong, and if we cancel an order you have paid for we refund you in full.

Shipping and returns

Our Shipping policy and our Return and refund policy form part of these terms.

Using the site

Do not misuse the site, try to disrupt it, or use it for anything unlawful. The content on this site, including our text, photographs, and branding, belongs to us and may not be copied for commercial use without our permission.

Limitation of liability

Our products are sold for recreational use. To the fullest extent permitted by law, Modern Mining Supplies LLC is not liable for indirect, incidental, or consequential damages arising from the use of our products or this site, and our total liability for any claim is limited to the amount you paid for the product. Nothing here limits liability that cannot be limited by law.

Changes to these terms

We may update these terms. Changes apply to orders placed after they are posted, never retroactively to an order you have already placed. The date below tells you the current version.

Governing law and where disputes are heard

These terms and any dispute about them or about anything you buy from us are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, except where the consumer protection laws of your home state give you rights that cannot be waived by agreement. Any action must be brought in the state or federal courts of Texas, and both of us consent to jurisdiction there. Nothing here stops you bringing an individual claim in small claims court.

Severability

If any part of these terms is found unenforceable, the rest still applies.
